On 13 August 2013 circular 2013HOC0457SS gave details on the unsuccessful appeal by the Government Actuary's Department (GAD) re the decision of the High Court last year in relation to the jurisdiction of the Pensions Ombudsman.
At the time of writing this circular it was not known if GAD intended to directly seek permission to appeal from the Supreme Court.
The Pensions Ombudsman had indicated that they should have more details on this by the end of the month.
The latest update from the Pensions Ombudsman has now confirmed that GAD does not intend seeking permission to appeal directly from the Supreme Court. This brings the court proceedings to an end and means that the decision of the Court of Appeal now stands.
This means that the Pension Ombudsman will now be able to carry out the investigation into our complaints.
